Canada making bold steps to address PFAS – both Cause and Effect.

March 25, 2025

Lately it seems that every day there is a new update or announcement on PFAS risk and exposure in our product choices, our health awareness, environmental contamination or regulatory changes that need to be adopted on a broad scale.

Much of this is regurgitating old headlines and key points from the growing library of data and activity that we are being bombarded with, as the acknowledgment of the real concerns with these “Forever Chemicals” becomes more common knowledge.

It is therefore refreshing to have confirmation that the Canadian government has taken real steps to further safeguard the environment and Canadian citizens with the release of the updated report on the State of Per- and Polyfluoroalkyl Substances.

With the proposed addition of the class of PFAS (excluding fluoropolymers) to Part 2 of Schedule 1 of the Canadian Environmental Protection Act, 1999 (CEPA), delivered through a 2 stage delivery model, we are seeing a relatively bold step to make a difference across a significant segment of risk exposure.  It would be perhaps utopian to consider including fluoropolymers in this initial phase, but some of these things take time….

This is perhaps not greatly different to the intent of the Australian NEMP 3.0, however the NEMP addresses the effect and result of contamination and exposure more so than the cause.  The Canadian plan sets out specifics in Phase 2, on limiting exposure to PFAS in products like cosmetics, food packaging and textiles.

Perhaps the most important aspect of this update to CEPA is the fact that it applies to the Class of PFAS (excluding fluoropolymers) rather than just a spattering of specific PFAS – there are after all over 10,000 known compounds widely used across all manner of products.

The plan has merit and it remains our view that by measuring and reporting the cause the serious steps are being taken to have an exponential impact on the effect that these ubiquitous “forever chemicals” are having on our planet and our health.
